Meal Periods and Rest Breaks

Employers in California must ensure that employees who work more than five hours take a 30-minute off-duty meal period. Employers in California must also authorize and permit employees who work more than three and one-half hours to take 10-minute off-duty rest breaks.

An employer that does not permit its employees to take off-duty rest breaks breaches its duty to authorize and permit such breaks.
